Probate in England for clients in Portugal

Purely Probate obtained probate in England for a deceased person who was Portuguese and had a bank account in the UK. This meant that the executors had to gain a Grant of Probate to release the money in the UK. We were instructed to make the application for Probate and correspond with the UK bank.

We had to gather some Portuguese documents to apply for probate, including the deceased’s Testamento, or Portuguese Will and the Habilitacao or Certificate of Inheritance, broadly equivalent to UK Probate. We completed forms to ensure that the UK tax authorities were happy. In this case there was no tax to pay in the UK.

It took a little time to gather all of these documents and apply for Probate, however we have now completed this and the client was very happy with the fixed price we agreed.
